Cabinet recommend to Prez to invoke Article 305

KATHMANDU, July 24: The government has recommended to President Bidya Devi Bhandari to invoke Article 305 of Nepal’s constitution to remove constitutional hurdles for the formation of a new government.

KATHMANDU, July 24: The government has recommended to President Bidya Devi Bhandari to invoke Article 305 of Nepal’s constitution to remove constitutional hurdles for the formation of a new government.



A cabinet meeting earlier today concluded that a new government cannot be formed as per Article 298 after the ouster of the current KP Sharma Oli government.



‘Therefore, we decided to recommend to the President to invoke Article 305 and remove the constitutional hurdles to form a new government,” said Peace Minister Eknath Dhakal.

Power to remove difficulties: If any difficulty arises in connection with the implementation of this Constitution until the commencement of the first session of the Federal Parliament, upon being elected in accordance with this Constitution, the President may, on the recommendation of the Government of Nepal, Council of Ministers, issue necessary orders to remove such difficulty; and such orders must be submitted to the Legislature Parliament or Federal Parliament, held immediately after the issue such orders, for approval.
