KATHMANDU, Oct 12: The complaint demanding that the candidature of Nepali Congress President Sher Bahadur Deuba from Dadeldhura for the membership of the House of Representatives (HoR) be scrapped has been dismissed stating that it was not in accordance with the law.
Karna Malla, who is a Nepali Congress (BP) candidate for the House of Representatives from Dadeldhura, had filed a complaint at the Election Officer's office demanding the cancellation of the candidacy of Deuba, who is also the Prime Minister, because he has different dates of birth on the citizenship certificate and the voter's list. Chief Returning Officer Balkrishna Wagle informed Republica that the complaint filed against Deuba's candidacy was not legal.
Meanwhile, the candidacy of People’s Freedom Party leader Reshamlal Chaudhary, who was convicted by the court in the Tikapur incident and is in jail at Dillibazar, has been canceled. Returning Officer of Bardiya-2, Nagendra Lamsal said that the candidacy of Chaudhary, who was nominated as a candidate for the membership of the House of Representatives in Bardiya-2 by a representative on behalf of People’s Freedom Party leader Chaudhary, has been canceled.
SC sentences Resham Chaudhary to life imprisonment
Lamsal said that Chaudhary's candidature was rejected as it was confirmed that Chaudhary was convicted by the District Court Kailali and High Court Doti and has been in continuous imprisonment since February 26, 2018. Lamsal said, "As he has been in prison continuously since February 26, 2018 and has been convicted by the High Court, according to Section 13 (i) of the House of Representatives Election Act 2074, he is ineligible to be a candidate."
According to Section 13 (b), (e) and (i) of the House of Representatives Election Act, 2074, Suresh Panth, the candidate of the CPN (Maoist Center) from Bardiya-2, had filed a complaint demanding cancellation of Chaudhary's candidature.
Similarly, the candidature of Lakshman Tharu, who was an independent candidate for the membership of the House of Representatives from Kailali Constituency 5 on behalf of the People’s Freedom Party, has also been rejected. The office of the Chief Returning Officer, Kailali rejected his candidature on Tuesday.
Ram Bahadur Singh of Dhangadhi Sub-metropolitan City had filed a complaint against his candidacy. Tharu was found guilty by the court in the Tikapur incident. Addressing the complaint, the Office of the Chief Returning Officer rejected his candidacy stating that he was unfit to be a candidate for the House of Representatives election according to federal law.
