SC denies issuing stay order on Silwal’s petition

KATHMANDU, April 12: The Supreme Court has denied issuing stay order on the writ petition of DIG Nawaraj Silwal against the appointment of Prakash Aryal as the Inspector General of Police (IGP).

KATHMANDU, April 12: The Supreme Court has denied issuing stay order on the writ petition of DIG Nawaraj Silwal against the appointment of Prakash Aryal as the Inspector General of Police (IGP).



A single bench of Justice Ishwor Khatiwada, however, has issued a show cause notice to the government on the appointment of Aryal as the IGP of the Nepal Police.

The SC in its order has stated that the court does not need to issue a stay order as per the principal of balance of convenience citing that  the newly appointed has already taken the charge of the Nepal Police.


The government on Monday had appointed Aryal to the post. Following the appointment, DIG Silwal had launched the writ petition challenging the government decision at the Supreme Court on Tuesday.  Silwal demanded in the writ petition that the Monday's decision of the Council of Ministers to promote Aryal as the new IGP should be scrapped so as to appoint him to the post. 


Prior to this, on February 12, the government had appointed Jay Bahadur Chand as the IGP, prompting Silwal to challenge the appointment in the court. In its response to a writ filed against the appointment of Chand, the SC had issued a verdict in the name of the government to make the appointment of a new police chief on a basis of work performance evaluation.
