An extended full bench including Chief Justice Gopal Parajuli decided to annul the writ, arguing that the decision of the Government to appoint Prakash Aryal as the IGP was legal and hence there was no need to move ahead with the writ filed by Silwal.

In addition to Chief Justice Parajuli, the extended full bench comprised Justices Om Prakash Mishra, Kedar Prasad Chalise, Sharada Prasad Ghimire, Meera Khadka, Prakash Man Singh Rawat and Pursottam Bhandari. RSS
