SC notice served on CIAA Chief Karki

KATHMANDU, Oct 18: Attempts to serve Supreme Court (SC)’s notice on Chief Commissioner at the Commission for the Investigation of Abuse of Authority (CIAA), Lokman Singh Karki finally bore fruits.

KATHMANDU, Oct 18: Attempts to serve Supreme Court (SC)’s notice on Chief Commissioner at the Commission for the Investigation of Abuse of Authority (CIAA), Lokman Singh Karki finally bore fruits.



A staffer at the apex court, who was assigned to deliver the notice, has submitted a report to the court’s administration mentioning that the notice has been served.


SC sources told Republica Online that the report states that the order was served in the presence of ward secretary on Monday evening.


SC Spokesperson Nahakul Subedi said that the court has been informed that the notice has been served.

After repeated attempts to serve notice at Karki’s house in Baneshwor Height were foiled, SC staffer served the notice at the ward office. 


Muluki Ain and SC regulations state that a court’s notice can be served at a defendant’s house, rented room or a nearby public place. 


Based on the provision, SC staffer served the notice and prepared a site report in presence of ward secretary.



Now, there are no hurdles to begin a hearing on the case filed against Karki’s appointment.


The Supreme Court on September 17 had decided to review its previous verdict on a writ petition challenging Karki’s appointment as the CIAA chief.


Advocate Om Prakash Aryal had filed two writ petitions on May 16, 2014 -- one demanding court order to stop the then government from appointing Karki, and another demanding annulment of the appointment decision.


A division bench of justices Gopal Parajuli and Om Prakash Mishra had quashed both the petitions on September 24, 2014


Meanwhile, SC is hearing a case for departmental action against SC staffer Khatri, who was initially assigned to serve the court notice but subsequently went out of contact.
