KATHMANDU, June 23: A case against Minister for Culture, Tourism and Civil Aviation, Prem Bahadur Ale is going to be taken up in the Supreme Court (SC). A writ petition was filed in the Supreme Court on June 19 alleging violation of public decency and conduct.
However, Registrar Narayan Prasad Panthi on June 19 had quashed the writ saying that the issue falls under the jurisdiction of the House of Representatives. The petitioners had reached the bench against the decision. Accordingly, a single bench of Supreme Court Justice Tanka Moktan on Wednesday revoked the registrar’s decision to quash the writ.

After the dismissal of the writ-quashing decision, the issue is now going to move forward at the apex court. "Our petition was quashed by the apex court administration under the pressure of the government," said Petitioner Advocate Kishor Poudel. “We also mentioned that the Parliamentary Conduct Monitoring Committee has not been formed to look into the matter in the House of Representatives.”
He said that the bench then paved the way for the issue to be taken forward. “The first thing we want is an independent lab test to see if the audio is true. The second is to have a social test,” he said. “If it is really him he is unfit for the position of a minister and we have demanded his dismissal from the post.”
Advocates duo Kishor Poudel, Anupam Bhattarai along with law student Regina Poudel had filed the writ petition at the Supreme Court alleging that the lawmakers had not complied with the 'Code of Conduct' as per Rule 216 of the House of Representatives Regulation, 2075 BS.
